Early Systems of Judicial Review: The Council of the Ephors in 1799 Neapolitan Republic Constitution

The short existence of the Neapolitan Republic in 1799 has bequeathed us a constitutional draft that, even with the unavoidable links to other foreign experiences, introduces institutions of great modernity in the history of constitutional law. The constitution derived by the modern political ideas of Mario Pagano that, inspired by his juridical and philosophical education, created an institution with the mandate to guarantee the constitutionality of laws and to judge the correct execution of State power. This entity, so similar to a modern Constitutional court, would be named “Corpo degli Efori” by Pagano.
