This paper studies the concept of the individual rights in the Spanish constitutionalism, by emphasising the evolution of its racionalistic and original conception’s characteristics, as well as the outcome of its contrast with the appearance of the colective rights with social or national, state or local rights, to analyse finally in what measure the historical identities in the Autonomy Statutes’ configuration can absorb or restrict the respect of the individual rights.
