This is an investigation about the legal and political context of the constitutional reforms in Imperial Brazil, seeking to analyze the function exercised by the Brazilian Constitution of 1824 as an argumentative reference in the discourses of the Legislative Power. Historical newspapers, speeches of the Brazilian Parliament are analysed, as well as dialogues with the literature about the Regency Era. By means of the Popperian hypothetical-deductive method, we intend to discuss if the constitutional framework, influenced by the Iberian Constitutionalism, would have been decisive for the constitutional changes (1831-1840). At the end, results were presented with analysis on the readjustments of the Brazilian State in the 19th century, especially the period that goes from the Abdication of Pedro I to the parliamentary movement of the Proclamation of the Majority of Pedro II.
