Comparative Constitutional History: Stages and Models

Abstract

In this essay I suggest chronological frameworks of the Constitutional History using more temporal than geographical criteria.  I distinguish four phases: the original (1688-1776) which was developed in Great Britain; the revolutionary (1776-1814) which is located in US, France and the Spanish world; the XIXth century stage (1814-1917), which shows the contrast between European and American constitutionalism; and finally the stage between the two World Wars (1917-1939), which is mainly the source of the present constitutionalism. Among those stages I show the different constitutional models which were created and their theoretical support.

Joaquín Varela Suanzes-Carpegna, Universidad de Oviedo

Catedrático de Derecho Constitucional de la Universidad de Oviedo y Director del Seminario de Historia Constitucional “Martínez Marina”, que edita  “Historia Constitucional” y promueve la editorial digital In Itinere. Miembro del Consejo Editorial del Centro de Estudios Políticos y Constitucionales, en donde dirige la colección “Clásicos Políticos”, es también codirector de “Fundamentos”. Forma parte del Consejo científico o asesor de varias revistas españolas e italianas. Entre sus más de ciento cincuenta publicaciones, algunas traducidas a varias lenguas, destacan sus libros: “Sistema de Gobierno y Partidos Políticos. De Locke a Park (CEPC, 2002, traducido al italiano en 2007), “El Conde de Toreno (1786-1843). Biografía de un Liberal” (Marcial Pons, 2005), “Asturianos en la política española” (KRK, 2006), “Política y Constitución en España. 1808-1978” (CEPC, 2007), “La Constitución de 1876” (Iustel,  2009) y, “La Teoría del Estado en las Cortes de Cádiz” (2ª edición, CEPC, 20011). Actualmente dirige la colección “Leyes Políticas Españolas. 1808-1978” y es autor del primero de sus cinco volúmenes: “Constituciones y Leyes Fundamentales” (Iustel, 2011). En 2012 publicará “La monarquía doceañista. 1808-1837” (Marcial Pons).
