The Interpretation of Constitution in United States of America according to the original intent: Interpretative Method, Semantic Presuppositions and Difficulties

This article aims at analyzing two main topics. First, I will offer a
reconstruction of the interpretative methodology of the so called “old
originalism” or “originalism of original intent”. In the second part, I will analyze
the main challenges of an originalist constitutional practice. More specifically, I
will exam the very possibility to reach or guarantee objectivity in constitutional
interpretation by the means of the semantic grounds in which “old originalism”
relies on.
