State of exception and (un)constitutional change in Brazil (1934-1937)

This paper analyzes the relationship between constitutional change and state of exception during the administration of Brazilian President Getúlio Vargas in the period between 1935 and 1937. The analysis will be on the historical context and the parliamentary debates related to the reform of the Brazilian Constitution of 1934 that aimed to increase the effects of the state of emergency. It also analyzes the political and legal consequences of that equation as well as attempts to rescue the background and justifications for the coup occurred in 1937 that began the period known as “Estado Novo”.
