The issue of constitutional reform in the Constitution of Cadiz and the problem of its temporal and material boundaries

The Cadiz Constitution of 1812 did not set any limit to its own reform. For this reason, the power of reform could change the Constitution without any formal restriction, according to Articles 373 and 374. However, the absence of intangibility clauses does not mean that the founding fathers of Spanish constitutionalism rejected the existence of implicit material limits the power of reform. This paper analyzes the different positions on constitutional reform defended by the deputies in the context of the various ideological positions of the constituent assembly of Cádiz in 1812.
