Religious Liberty and tolerance: “no-catholic Portuguese” in Ultramar in the XIXth Century

Abstract

This article studies the political and legal status of the non-catholic native peoples from the Portuguese Empire during the XIXth Century. Firstly we study the discussion on the constitutional articles on religion, as it shows that the constitutional solution to the religious pluralism in the colonies was not able to solve the problem about the nationality and citizenship. This lack of solution to that question allowed central government and local governors to decide each time the legal status of the people from the colonies. Therefore, this status was changing due to the different political projects from the central and local governments.

Cristina Nogueira da Silva, Universidade Nova de Lisboa

Profesora de la Facultad de Derecho de la Universidade Nova de Lisboa, donde imparte las materias de Historia del Derecho e Historia de las ideas. Doctora en Historia del Derecho con la tesis titulada A cidadania nos Trópicos: O Ultramar no constitucionalismo monárquico português (1820-c. 1880). Ha publicado diversos artículos sobre derecho colonial, organización política del imperio portugués, esclavitud y abolicionismo portugués, así como sobre el estatuto jurídico de las personas libres en los territorios coloniales portugueses. Igualmente ha publicado trabajos sobre la organización política de los territorios portugueses y su reforma en el siglo XVIII.
